REPRESENTATION OF THE PEOPLE
The European Parliament (Representation) Act 2003 (Commencement No. 4) Order 2004
The Secretary of State, in exercise of the powers conferred on him by section 28(3) and (4) of the European Parliament (Representation) Act 2003[1], makes the following Order:
Citation
1.
This Order may be cited as the European Parliament (Representation) Act 2003 (Commencement No. 4) Order 2004.
Commencement of provisions in European Parliament (Representation) Act 2003
2.
The following provisions of the European Parliament (Representation) Act 2003 shall come into force on 5 February 2004 -
(a) in the United Kingdom and Gibraltar -
(i) sections 20 and 21 for all remaining purposes; and
(ii) section 19 except so far as it -
(aa) was brought into force by the European Parliament (Representation) Act 2003 (Commencement No. 3) Order 2004[2]; or
(bb) relates to section 1A and 8 of, and Schedule 1A to, the European Parliamentary Elections Act 2002[3]; and
(b) in Gibraltar -
(i) sections 1 and 8; and
(ii) section 28(2) so far as it relates to the provisions brought into force by paragraph (a) and sub-paragraph (i) above.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order brings into force on 5th February 2004, in the United Kingdom and Gibraltar, the provisions of the European Parliament (Representation) Act 2003 relating to returning officers and disqualification from office of MEP so far as they have not already been brought into force by the earlier commencement orders mentioned below. It also brings into force section 19 for most remaining purposes (which provision extends to Gibraltar the European Parliamentary Elections Act 2002) except in respect of provisions concerning the entitlement to vote and reviews as to the distribution of MEPs amongst the electoral regions.
It brings into force for Gibraltar section 28(2) (which extends the Act to the United Kingdom and Gibraltar) so far as it relates to the above mentioned provisions. It also brings into force in Gibraltar sections 1 and 8, which relate to the number of MEPs and electoral regions. Sections 1, 8 and 28(2) came into force in the United Kingdom on Royal Assent of the Act.
NOTE AS TO EARLIER COMMENCEMENT ORDERS
