The General Teaching Council for Wales (Additional Functions) (Amendment) Order 2007

  Made 25 September 2007 
  Laid before the National Assembly for Wales 26 September 2007 
  Coming into force 20 October 2007 

The Welsh Minsters in exercise of the powers conferred on the Secretary of State by sections 7(1) and (3) and 42(6) and (7) of the Teaching and Higher Education Act 1998 and now vested in them[1], being of the opinion that the General Teaching Council for Wales may, in conjunction with its other functions, appropriately discharge the additional functions hereby conferred, and having carried out such consultation as appears to them to be appropriate in accordance with section 7(2) of the Teaching and Higher Education Act 1998 make the following Order.

Title and commencement
     1. The title of this Order is the General Teaching Council for Wales (Additional Functions) (Amendment) Order 2007 and comes into force on 20 October 2007.

    
2. The General Teaching Council for Wales (Additional Functions) Order 2005[2] is amended as follows.

     3. —(1) In article 2 in the definition of "the Directive" ("y Gyfarwyddeb") for "89/48/EEC" substitute "2005/36/EC".

    (2) In article 2 in the definition of "the Regulations" ("y Rheoliadau") for the words "the European Communities (Recognition of Professional Qualifications) (First General System) Regulations 2005" substitute "the European Communities (Recognition of Professional Qualifications) Regulations 2007.".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the General Teaching Council for Wales (Additional Functions) Order 2005 ("the 2005 Order") by substituting for reference to Council Directive 89/48/EEC reference to Council Directive 2005/36/EC.

The 2005 Order is also amended by substituting for reference to the European Communities (Recognition of Professional Qualifications) (First General System) Regulations 2005 reference to the European Communities (Recognition of Professional Qualifications) Regulations 2007.

The functions of the Secretary of State under these sections were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) and then to the Welsh Ministers under paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c.32).back
