The Feed (Corn Gluten Feed and Brewers Grains) (Emergency Control) (Wales) (Revocation) Regulations 2007

The Welsh Ministers make the following Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972[1].

     The Welsh Ministers are designated for the purposes of that section in relation to the control and regulation of the deliberate release, placing on the market and transboundary movements of genetically modified organisms[2], measures relating to food (including drink) including the primary production of food and measures relating to feed produced for or fed to food-producing animals[3], the common agricultural policy of the European Community[4] and measures in the veterinary field for the protection of public health[5].

     There has been open and transparent consultation during the preparation of these Regulations in accordance with the requirements of Article 9 of Regulation (EC) No. 178/2002 of the European Parliament and of the Council[6] laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety.

Title and commencement
     1. The title of these Regulations is the Feed (Corn Gluten Feed and Brewers Grains) (Emergency Control) (Wales) (Revocation) Regulations 2007, they come into force on 30 November 2007 and apply in relation to Wales.

Revocation
    
2. The Feed (Corn Gluten Feed and Brewers Grains) (Emergency Control) (Wales) Regulations 2005[7] are revoked.

Consequential amendments to the Genetically Modified Animal Feed (Wales) Regulations 2004
     3. —(1) The English text of regulation 8 (inspection, seizure and detention of suspected animal feed) of the Genetically Modified Animal Feed (Wales) Regulations 2004[8] is amended in accordance with paragraphs (2) and (3).

    (2) In paragraph (5) for the expression "Subject to paragraphs (5A), (5B) and (6)" substitute the expression "Subject to paragraph (6)".

    (3) Paragraphs (5A) and (5B) are omitted.

Consequential amendment of the Official Feed and Food Controls (Wales) Regulations 2006
     4. In Schedule 2 (definition of relevant feed law) of the Official Feed and Food Controls (Wales) Regulations 2006[9], paragraph (f) is omitted.

EXPLANATORY NOTE

(This note is not part of the Regulations)


    
1. These Regulations revoke the Feed (Corn Gluten Feed and Brewers Grains) (Emergency Control) (Wales) Regulations 2005 (S.I.2005/1323 (W.97), and make consequential amendments to the Genetically Modified Animal Feed (Wales) Regulations 2004 (S.I. 2004/3221 (W.277)) and the Official Feed and Food Controls (Wales) Regulations 2006 (S.I. 2006/590 (W.66)).

    
2. The Regulations implement Commission Decision 2007/157/EC repealing Decision 2005/317/EC on emergency measures regarding the non-authorised genetically modified organism Bt 10 in maize products (OJ No. L68, 8.3.2007, p.8).

    
3. A full regulatory impact assessment has not been produced for these Regulations because no impact on the private or voluntary sectors is foreseen.
